By accessing or using the Juander Learning Platform ("Service"), operated by Juander ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service, including administrators, instructors, and learners.
Juander is a cloud-based eLearning platform that provides course creation tools, a learning management system (LMS), assessment and certification features, and related services. Each subscribing organization receives a dedicated server instance with their own domain.
When you create an account, you must provide accurate and complete information. You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
The Service is billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring monthly or annual basis depending on the plan you select.
All plans include a base number of active users. Additional users may be added at the per-user rate specified for your plan. Pricing is subject to change with at least 30 days' advance notice.
We offer a 15-day free trial. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.
We may offer a free trial period. At the end of the trial, your account will be suspended unless you subscribe to a paid plan. We reserve the right to modify or discontinue the free trial at any time without prior notice.
Your Content: You retain all rights to the content you create, upload, or distribute through the Service, including courses, assessments, media, and documents. You grant us a limited license to host, store, and display your content solely for the purpose of providing the Service.
Our Content: The Service, its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Juander. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.
You agree not to use the Service to: upload or distribute illegal, harmful, or offensive content; infringe upon the intellectual property rights of others; attempt to gain unauthorized access to the Service or its related systems; distribute malware, viruses, or other harmful code; use the platform for spam or unsolicited communications; or violate any applicable laws or regulations.
Your privacy is important to us. Please review our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.
Each subscribing organization is provided with a dedicated server instance. You are responsible for managing your users and content within your instance. We are responsible for server maintenance, security updates, and uptime. Server specifications vary by plan and are subject to fair use policies.
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may request an export of your data within 30 days of termination. After 30 days, we reserve the right to delete your data and server instance.
Refunds are handled on a case-by-case basis. If you are unsatisfied with the Service within the first 30 days of a paid subscription, contact us to discuss a refund. Annual subscriptions are non-refundable after 30 days.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for any downtime or data loss resulting from circumstances beyond our reasonable control.
In no event shall Juander, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through good faith negotiation, and if necessary, through the courts of competent jurisdiction.
